Winter Scientific School "Human Rights in the modern world".

 

On March 6, 2024, the next lesson was held. The moderator of the event is Doctor of Law, Professor A.S. Ibraуeva.

 Speaker – Doctor of Law, Professor Baimakhanova D.M. Lecture topic: "The concept and stages of formation of constitutional control in the Republic of Kazakhstan". 

The formation, development and tasks of the constitutional control bodies in the Republic of Kazakhstan were considered. The main task of constitutional control is to eliminate conflicts between different branches of government, especially between the legislative and executive branches; to ensure the guarantee of human and civil rights and freedoms, real equality of citizens; interpretation of the norms of the Constitution.

Constitutional control bodies include the Head of State, the Government, Parliament, courts of general jurisdiction, and administrative courts. Specialized constitutional control bodies can be judicial and quasi-judicial. 

The composition, formation procedure, principles of organization and activity of the Constitutional Court of the Republic of Kazakhstan were considered.

The subjects of an appeal to the Constitutional Court may be the President of the Republic of Kazakhstan, the Chairman of the Senate, the Chairman of the Mazhilis, at least one fifth of the total number of deputies of Parliament, the Prime Minister. Citizens of the Republic of Kazakhstan can also apply to the Constitutional Court.
