"Juvenile and Family Courts: foreign experience and Kazakhstani practice."

On February 21, 2025, the Department of Civil Law and Civil Procedure, Labor Law discussed the dissertation of Dariga Kazbekovna Ospanova, a doctoral student at the Caspian Public University, for the degree of Doctor of Philosophy (PhD) on the topic "Juvenile and Family Courts: foreign experience and Kazakhstani practice." The discussion was held with the participation of a scientific consultant, Doctor of Law, Professor Svetlana Pavlovna Moroz. Candidate of Law, Associate Professor Arhat Ashmetovich Abikenov, Candidate of Law Saltanat Karibayevna Atakhanova and senior lecturer of the Department Akku Tursunovna Muksinova, who gave their recommendations on the dissertation, were appointed official reviewers. The topic of the dissertation aroused great interest among all participants of the meeting, all relevant issues of the development of juvenile justice in the Republic of Kazakhstan were raised.
The dissertation research is devoted to the study of the genesis and development of family courts in foreign countries in order to integrate successful international experience into the legislation of the Republic of Kazakhstan. The research is aimed at analyzing various models of family courts, their formation and development in various jurisdictions, ranging from historical context to modern approaches.
The main aspects of the study include an analysis of the legal and institutional structure of family courts in various countries, their functions, competencies and working methods, with special attention paid to positive practices in the field of family dispute resolution, protection of children's rights and strengthening family values.
Singapore's experience in the development of family courts, reviewed by the dissertation researcher, was of particular interest. In particular, the author substantiates the need to improve the legislation of the Republic of Kazakhstan by integrating the concept of therapeutic justice into it, aimed at reducing the level of conflict and creating favorable conditions for all participants in family disputes through amendments and additions to the family legislation of the Republic of Kazakhstan, training judges, lawyers, psychologists and social workers in therapeutic justice methods.; organization of specialized counseling centers at family courts; and raising public awareness about the benefits of therapeutic justice.
Following the discussion, it was decided to recognize Dariga Kazbekovna Ospanova's dissertation as fully compliant with the requirements for dissertation research for a PhD degree, including relevance, novelty and depth of study of the topic and recommend the work for defense.
