Human rights and freedoms are given priority in the new draft Constitution

SDG-4 In the new draft Constitution, human rights and freedoms are for the first time declared the state’s main priority. This idea runs throughout the entire text of the Constitution.

🖇️ When drafting the provisions of the section “Fundamental Rights, Freedoms and Duties,” the requirements of the Universal Declaration of Human Rights, international covenants ratified by the Republic of Kazakhstan, and other generally recognized international instruments were fully taken into account. As a result, the content of personal, socio-economic, and political rights of individuals and citizens has been expanded and new dimensions have been revealed. Guarantees for their implementation and protection have been significantly strengthened.

The new draft Constitution prioritizes the protection of fundamental human rights.

✒️ For example, it establishes the absolute nature of the right to life, personal inviolability, protection of personal data in the digital age, as well as the introduction of the “Miranda rule.”

In addition, the draft addresses issues of freedom of speech, scientific, technical, and creative freedom, and the protection of intellectual property rights.

Special attention is given to the protection of the rights of women and children. In particular, the principle of separation of religion and the state is закреплено. With the exception of spiritual and religious educational institutions, the education and upbringing system is declared secular.

Furthermore, a provision is introduced stating that marriage is a voluntary and equal union between a man and a woman. This approach is aimed at protecting women’s rights and strengthening traditional values.

📰 The draft Constitution is the result of six months of intensive work by prominent lawyers, the expert community, and members of parliament. The proposed amendments to the Basic Law cover all sections and 77 articles, accounting for 84% of the text.
