The international forum of jurists ended in KazNU

The II Central Asian International Scientific and Educational Forum "Law as the basis of regional economic integration" continued its work in four sections at the Al-Farabi Library. The two-day forum is attended by scientists and experts from the Russian Federation, Uzbekistan, PRC and other countries.

 

The second day of the Forum started with four sections on different topics. Thus, the 6th section was devoted to the topic "Constitutional and legal construction in the countries of Central Asia". 

Speaking as a moderator, Vice-Rector for Operations of Al-Farabi KazNU, Professor Erkin Duisenov drew the attention of the participants to a number of legal constitutional issues. In 2020, the Russian Federation, Armenia, the Kyrgyz Republic, the Republic of Belarus, the Republic of Kazakhstan passed constitutional reforms, which significantly modernized the basic laws of their countries. According to Vice-Rector Yerkin Duisenov, today there is a need in the field of legislation to implement certain norms, including the constitutional legislation of neighboring countries and partners. "This is a question of moral and ethical character and legal at the same time. It is related to the preservation of our traditional spiritual values.

Constitutional reforms in four countries, such as Belarus, Russia, Armenia, and Kyrgyzstan, have significantly affected marriage and family relations.  The constitution stipulates that marriage is a union between a man and a woman. The LGBT movement and the values imposed on us by alien Western democracies are not acceptable to traditional Kazakhstan. Therefore, fixing as a legal norm of marriage as a union between a man and a woman will be a real legal barrier to the fact that this movement and alien to us moments associated with same-sex marriages, in particular, the adoption of children by such families, could not be taken into our legal reality", - said in his speech Vice-Rector E. Duisenov.

The Vice-Rector also drew attention to the significant expansion of the constitutional legal regulation of science in the Russian Federation, Belarus, Armenia and Kyrgyzstan. The Constitution, the state of the Russian Federation guarantees the development of science, creates conditions. "At us all this is limited to one provision of Article 25, according to which freedom of speech and creativity is guaranteed. This is not enough to give an impetus to the development of science in our country. If we want to further develop our Kazakhstani science, we need to create conditions at the level of the Constitution, specifying and expanding the scope of constitutional and legal regulation," - said Professor E. Duisenov. The speaker also touched upon the issue related to social protection of citizens, in particular concerning the right of citizens to labor. 

Oman Mukhamedjanov, Professor of the International Law and Human Rights Department of the Tashkent State Law University, also spoke at the section meeting and informed about the development of constitutional law and the ongoing economic processes and successful investment activities in the country.

Dina Baimakhanova, Professor of the Department of Theory and History of State and Law, Constitutional and Administrative Law of Al-Farabi KazNU, made a report on "Constitutional Reform 2022 - the basis for improving the constitutional legislation of the Republic of Kazakhstan". The speaker noted that the Constitutional reform of 2022 in the RK, its main direction has the provision, guarantee, protection of rights and freedoms of man and citizen. "This is aimed at the development of the electoral system of the RK. In particular, the Majilis is now formed using majoritarian and proportional systems. The Constitutional Court of the RK was established to replace the Constitutional Council of the RK. Citizens of the Republic of Kazakhstan can now appeal directly to the Constitutional Court. The Constitution enshrines the basis of the legal status of the Ombudsman in the Republic of Kazakhstan", - said Prof. D. Baimakhanova. Also with the report "Ensuring the rights of freedoms of man and citizen in the Republic of Kazakhstan: Problems of theory and practice" was made by Professor Alua Ibrayeva of the Department of Theory and History of State and Law, Constitutional and Administrative Law of Al-Farabi KazNU. "Human rights is an opportunity to act. It is a priori inherent in a person from birth. Kazakhstan adopts the theory of natural law for this very reason, the Constitution of the RK in Article 12 stipulates that human rights are absolute. Therefore, in the Constitutional Reform of 2022, the death penalty is completely prohibited," said Prof. Alua Ibraeva.

In parallel, thematic sections were successfully held within the framework of the forum. Thus, in the 9th section Oleg Zaitsev, Doctor of Law, Professor, Dean of the Graduate School of Jurisprudence of the Institute of Legal Studies of the Presidential Academy, member of the Board of the Russian Bar Association, acted as a moderator. Dr. Konstantin Korsik, PhD, President of the Federal Chamber of Notaries of the Russian Federation, made a report on "Partnership of notaries of the EAEU countries as an important factor of integration in the legal sphere".  During the section Dr. Law, Professor, Vice-Rector for Operations of Al-Farabi Kazakh National University named after Al-Farabi Yerkin Duisenov on behalf of the Rector of KazNU presented the guest with memorable gifts. At the end of the forum an excursion program was organized for the guests. It should be noted that the forum was held under the grant of the Science Committee of the Ministry of Education and Science of the Republic of Kazakhstan.
