
One of the prominent figures who made a significant contribution to the development of legal science in our country, established a distinctive school, mentored numerous students, and greatly increased the legal literacy of society was Arikbay Agibaev, Doctor of Law, Professor, and Honored Worker of the Republic of Kazakhstan.
It has been over a year since the passing of this exemplary teacher. Arikbay Nusaypaliyevich wrote substantial works in legal science, authored textbooks and educational-methodical materials, and was directly involved in the legal reforms in Kazakhstan as an experienced scholar.
A devoted professional in his field, a mentor to the younger generation, and a respected scholar, his fruitful work has led him to be recognized as one of the corifeys of domestic legal science.
Arikbay Nusipaliuly, who held an esteemed position at the Kazakh National University, was born in 1941 in the village of Kastek, Zhambyl District, Almaty Region. His great-grandfather, Narbota bi, whose fair decisions illuminated the minds of those around him, inspired young Arikbay to pursue the challenging path of striving for justice with wisdom. In 1967, Arikbay Nusipaliuly graduated with honors from the Faculty of Law of our university while being a recipient of the Lenin Scholarship. By the decision of the Academic Council, he was sent to the Academy of Sciences of the Kazakh SSR. This path later led the future prominent scholar to the postgraduate program at the Institute of State and Law of the USSR Academy of Sciences. From November 1970 to March 1973, under the guidance of the distinguished scientist P.S. Romashkin, he defended his candidate dissertation on the topic "Criminal Liability for Abuse of Office and Authority" (based on materials from the Kazakh SSR) at the dissertation council of the Academy. The thorough analysis of issues related to the fight against crime highlighted the multifaceted nature of criminal liability. Determining criminal liability should not be one-sided; it is a legal phenomenon that integrates both the state's rights to punish offenders and the burden it imposes on them. Arikbay Agybaev was the one who brought this phenomenon to the public's attention.
Arikbay Agybaev is a leading expert in the fields of criminal law and criminology. He was actively involved in drafting the new Criminal Code of the Republic of Kazakhstan. He is the author of more than 560 scientific works, totaling over 670 printed pages.
A qualified scholar, he supervised the dissertations of 26 candidates and served as a scientific advisor to four doctoral candidates. Considering that legal restrictions and genuine coercive relationships can apply not only to those who refuse to voluntarily comply with legal norms, but also to those who do not resist violations, it is clear that the scholar made significant contributions in this area.
In order to raise public legal awareness, from 1981 to 1990, he hosted the "Human, Society, and Law" television program on Kazakh Television on a public basis. From 1998 to 2001, as a scientific secretary and member of the doctoral dissertation defense council at KazNU, he contributed to the development of Kazakh science by supporting young scholars.
A sense of responsibility, the high degree to which an individual feels their duty to society and the state, not only acts as a restraining force against the emergence of crime but also enhances the effectiveness of the psychological concept of "duty." Arikbay Agybaev is considered a scholar who does not owe his duty to anyone.
A scholar who does not separate history and law, in addition to his scientific works in the legal field, also wrote numerous pieces on literature and history. His historical essays on such figures as Karasai Batyr, Suinbay, Zhambyl, Süranshy, Sütbay, and Narbota Bi have contributed significantly to the intellectual heritage, earning him the International Zhambyl Jabayev Award and the title of "Honorary Citizen" of Zhambyl District.
As a staunch advocate of justice and a figure who left a lasting mark on the legal development of our country, the scientific path of Arikbay Nusipaliuly, our esteemed scholar and mentor, will continue through his followers.
