October 24, 2024 at the Faculty of Law of KazNU named after Al-Farabi in the auditorium 401 in the framework of the event dedicated to the National Holiday Day of the Republic and the tasks aimed at the implementation of the Sustainable Development Goals (SDG 16), teachers of the Department of Civil Law and Civil Procedure, Labor Law, Ph, acting associate professor Ermukhamedova S.R., associate professor Abikenov A.A., organized a meeting with the students of the 2nd course with the notary of the Notarial Chamber of Almaty city Kanagatova Parida Dingazievna.
As a highly professional practitioner Parida Dingazievna outlined the topic of her speech related to the most topical issues of notarial activity. There were also briefly covered the history of the formation of the notariat in Kazakhstan, the formation and activities of the Republican and territorial notarial chambers, as well as foreign experience of organization and functioning of the notariat (on the example of France), the peculiarities of the adoption of the Law of the Republic of Kazakhstan dated July 14, 1997 № 155-I “On Notariate”.
Notary, as Parida Dingazievna emphasized, is one of the traditional legal institutions to provide qualified legal assistance to individuals and legal entities by performing notarial acts. Notarial activity, today, is one of the most demanded types of activity among lawyers. Along with the state notaries, today, perform notarial acts also private notaries, which are more than four thousand in the country. In Almaty, 850 private notaries are included in the register of the Department of Justice of Almaty. However, despite the demand for this legal profession, it is not easy to become a notary. Thus, in order to provide notarial services, you need to obtain the appropriate license. To obtain it, it is necessary to have a higher legal education, work experience in the legal specialty for at least two years, internship with a notary for a period of not less than one year, attestation in the attestation commission of justice.
Parida Dingazievna covered in detail the issues of implementation of the pilot project ‘Digital Notary’, conducted jointly by the Ministry of Justice of the Republic of Kazakhstan and the Republican Chamber of Notaries. Within the framework of this project, today the population will be given the opportunity to execute all types of powers of attorney in online format, except for powers of attorney related to the disposal of property.
At the end of the event, various questions were asked by the students. Among them, the following can be noted: 1. What are the requirements for persons applying for the position of a notary? 2. What normative acts are used to carry out notarial record keeping? 3. Who appoints to the position of notary? 4. What is the procedure for transactions with immovable property? 5. What restrictions are provided for foreign citizens in notarial actions on the territory of the Republic of Kazakhstan and a number of other relevant questions. Parida Dingazievna gave informative and comprehensive answers to all the questions asked.
In general, the lecture was held in the format of a relaxed conversation, which aroused wide interest and sympathy among the students. As a result of this meeting, many students expressed their desire to undergo industrial practice with Parida Dingazievna.
